follows clearly delineated guidance in Florida Statutes regarding the
responsibilities of boards of trustees, college presidents,
administrators, and faculty in developing and implementing policy.

Florida Statute
1004.73 was revised in 2001 by the Florida State Legislature to include
a special provision addressing the status of St. Petersburg College as a
four-year College:

PETERSBURG COLLEGE; MISSION; POLICIES.--St. Petersburg College shall
immediately seek accreditation from the Southern Association of
Colleges and Schools as a baccalaureate degree granting college.
(a) The
primary mission of St. Petersburg College is to provide high-quality
undergraduate education at an affordable price for students and the
state. The purpose is to promote economic development by preparing
people for occupations that require a bachelor's degree and are in
demand by existing or emerging public and private employers in this
state.
(b) St.
Petersburg College shall maintain the mission and policies of a
Florida community college, including the open-door admissions policy
and the authority to offer all programs consistent with a community
college's authority.
St. Petersburg
College, with its two-year mission intact, follows the legislative
guidance for community colleges. The Florida Statutes and State Board
of Education Rules for community colleges are very specific and detailed
regarding the distinctions between the duties of the Board and the
President and his staff.

St. Petersburg College is governed by
the State Board of Education (SBE), the chief policymaking and
coordinating body of public education in Florida. The Board of Trustees
is responsible for policy decisions appropriate to the College’s
mission. The BOT is responsible for setting policy with regard to
academic, business and finance, governance and organization, personnel,
and student matters, and for providing guidelines of the implementation
of those policies. Included in the broad range of responsibilities of
the Board of Trustees is the following partial list of duties and
powers:

Instituting cost-effective policy decisions appropriate to the
community college's mission, the implementation and maintenance of

administration, programs, curriculum and instruction, buildings and
grounds, travel and purchasing, technology, students, contracts and
grants, or college property.

Taking action without a recommendation from the president and
requiring the president to deliver all data and information required
by the board of trustees in the performance of its duties.

Establishing and discontinuing program and course offerings;
provision for instructional and non-instructional community
services, location of classes, and services provided; and
dissemination of information concerning such programs and services.
New programs must be approved by the State Board of Education.
Student
related duties and powers:

Establishing policies related to students, enrollment of students,
student records, student activities, financial assistance, and other
student services.

Governing admission of students.
·
Establishing student performance standards for the award of degrees
and certificates.
·
Establishing a uniform code of conduct and appropriate penalties for
violation of its rules by students and student organizations,
including rules governing student academic honesty.
Financial
duties and powers:
·
Establishing fees.
·
Submitting an institutional budget request, including a request for
fixed capital outlay, and an operating budget to the State Board of
Education.
·
Accounting for expenditures of all state, local, federal and other
funds.
Personnel-related duties and powers:
·
Appointing, suspending, or removing the president of the community
college. Evaluating the president and submitting the evaluations to
the State Board of Education.
·
Establishing the personnel program for all employees.
Support-related duties and powers:
·
Being responsible for the use, maintenance, protection, and control
of community college owned or community college controlled buildings
and grounds, property and equipment, name, trademarks and other
proprietary marks, and the financial and other resources of the
community college. Such authority may include placing restrictions
on activities and on access to facilities, firearms, food, tobacco,
alcoholic beverages, and distribution of printed materials,
commercial solicitation, animals, and sound.

Adopting rules and procedures related to data or technology.

on the roles and responsibilities of the President of the College.
Roles of the College President are outlined in Florida Statute 1001.65
and in State Board of Education Rules. The president serves as the
executive officer and corporate secretary of the board of trustees and
is responsible to the board of trustees for setting the agenda for
meetings of the board of trustees in consultation with the chair.

achieve the goals of the community college.

Establish the internal academic calendar of the community college.

Ensure compliance with federal and state laws, rules, regulations,
and other requirements that are applicable to the community college.
Instructional
duties and powers:
·
Recommend to the board of trustees the establishment and termination
of programs within the approved role and scope of the community
college.
·
Award degrees.
Student
related duties and powers:
·
Govern admissions.
·
Administer the community college's program of intercollegiate
athletics.
·
Have authority, after notice to the student of the charges and after
a hearing thereon, to expel, suspend, or otherwise discipline any
student who is found to have violated any law, ordinance, or rule or
regulation of the State Board of Education or of the board of
trustees of the community college.
Financial
duties and powers:

Prepare a budget request and an operating budget for approval by the
community college board of trustees.
·
Recommend to the board of trustees a schedule of tuition and fees to
be charged by the community college.
·
Approve, execute, and administer contracts for and on behalf of the
community college board of trustees.
Personnel-related duties and powers:
·
Establish and implement policies and procedures to recruit, appoint,
transfer, promote, compensate, evaluate, reward, demote, discipline,
and remove personnel.

Annually evaluate, or have a designee annually evaluate, each
department chairperson, dean, provost, and vice president in
achieving the annual and long-term goals and objectives of the
community college's employment accountability plan.
Support-related duties and powers:
·
Maintain all data and information pertaining to the operation of the
community college, and report on the attainment by the community
college of institutional and statewide performance accountability
goals.
·
Act as custodian of all community college property and financial
resources.
The State Board of
Education further delineates the president’s role as executive head for
the administration and Faculty.

Florida Statute and
State Board of Education Rules address requirements for community
college Faculty to maintain a specific course workload and availability
to students:

Faculty; minimum teaching hours per week
Each full-time member of the
teaching Faculty at any community college shall teach a minimum of
15 classroom contact hours per week at such institution. However,
the required classroom contact hours per week may be reduced upon
approval of the president of the institution in direct proportion to
specific duties and responsibilities assigned the Faculty member by
his or her departmental chair or other appropriate college
administrator. Such specific duties may include specific research
duties, specific duties associated with developing television, video
tape, or other specifically assigned innovative teaching techniques
or devices, or assigned responsibility for off-campus student
internship or work-study programs.
Florida State Board of Education Rule
6A-14.0491 Instructional Personnel - Availability to Students
Each community
college board of trustees shall establish a policy on the
availability of instructional personnel to students. The policy
shall require full-time instructional Faculty to schedule a minimum
total of twenty-five hours per week for classroom contact hours and
office hours as adjusted for assignments during non-traditional
academic terms and non-traditional delivery. Part-time Faculty
shall be available to students as prescribed by board policy.

developed for the operation of the College are contained in the Board of
Trustees Rules and Procedures Manual. The Board has clearly defined the
distinction between the Board’s role and the President’s role:

fullest cooperation and recognition of the responsibilities which evolve
upon the Board as a rule-making body and upon the President as the chief
executive.
Board of
Trustees. The Board Rules
identify the source of the Board of Trustees’ authority from the Florida
Legislature:
6Hx23-1.03 BOARD OF TRUSTEES I. The
general duties and powers of the Board of Trustees are those prescribed
in Section 240.319, F.S. and Senate Bill 1162, 2001 Legislature.
The Board considers
rules and standards based upon the advice, counsel and recommendation of
the College President.
President of the
College. The president of
the institution and his or her designees are responsible for the
implementation of BOT rules and for the efficient operation of the
college.
6Hx23-1.06 RESPONSIBILITY AND
AUTHORITY OF THE PRESIDENT. I. The Board of Trustees delegates to the
President administrative authority over the College and holds the
President responsible for the efficient direction and operation of the
College under the rules adopted by the Board of Trustees.
In accordance with the President’s job
description the President is the Chief Executive Officer of the College.
Administration.
The administration has the right to establish its own internal
procedures, as long as they are not in conflict with the law or the
Rules of Board of Trustees 6Hx23-1.09.
6Hx23-1.09 NATURE & REQUIREMENTS OF
FORMAL & INFORMAL PROCEDURES. I. The nature of all formal and informal
procedures is to provide for an efficient operation within the limits of
the laws and rules governing the Board of Trustees.
A. Formal procedures
shall be established by the president and may be submitted to the
President’s Cabinet for their advice. Formal procedures are contained
in the procedures manual.
B Informal procedures (internal
management memoranda) may be established by budget supervisors and
administrators as needed.
The development of
these recommendations is the responsibility of each administrative unit
and the President’s Cabinet. The administrator responsible for each
functional area is charged with ensuring that Board rules that are
necessary and relevant to support his/her area of responsibility are
current and in accordance with applicable Florida Statutes and State
Board rules, since all actions taken by an administrator in accordance
with established levels of authority must be in accordance with the
provisions of appropriate statutes, rules and procedures. Appropriate

Student Handbook, Faculty Manual, and the Supplement to the Faculty,
Staff and Student Handbooks, all published annually.
Faculty.
The roles and responsibilities of Faculty are defined in the Faculty

The process by
which Baccalaureate degrees were added to the College provides a clear
example of the distinctiveness in lines of authority. In 2000 the Board
stated its position to “support collaborative efforts to expand
baccalaureate and post-graduate access for students in the county.” The
President tasked his staff to continue expanding the University
Partnership Center’s baccalaureate and graduate programs from other
colleges, which opened in 1999 and moved into its new facility in 2001,
as well as pursuing legislation that would allow St. Petersburg College
to offer selected baccalaureate programs in high-need areas, such as
nursing, teaching, and technology management. When legislation passed
in 2001, SPC staff began preparing for SACS accreditation while the
Faculty began preparing curriculum. The curriculum for the first three
programs was approved by the Board in October 2001. In 2002, the staff
prepared the Legislative Budget Request for Upper Division Instruction,
which was adopted by the Board. In March, 2002, the Board was briefed
on the implementation of the 4-year program: at that time the staff and
Faculty were conducting Faculty searches, finalizing curriculum,
developing class schedules, and arranging for facilities for all initial
Baccalaureate offerings, and preparing publicity and marketing for a
scheduled Fall 2002 opening for the Nursing program. In each step of
the process, the Board set policy and approved all budgets and
recommended curriculum, which were then implemented by the staff and
Faculty.

comprehensive Web sites with the legislative and executive direction on
the roles and responsibilities of Boards of Trustees and Presidents in
the K-20 system.

members receive an orientation from the President and the College
